Terms of Use
These Terms of Use ("Terms") form a binding agreement between you and Ward & Partners ("we", "us", "BluePadel") in respect of your use of the BluePadel apps and any related services. By installing, opening, or subscribing to BluePadel you agree to these Terms. If you don't agree, please uninstall the apps and cancel any active subscription.
1. Eligibility
You must be at least 18 years old, or be using BluePadel with the consent and under the supervision of a parent or legal guardian, to subscribe. By subscribing you confirm you meet this requirement.
2. The service
BluePadel is a padel scoring application consisting of two paired apps: BluePadel for Wear OS (the watch scorer) and BluePadel Companion for Android (the phone history and stats app). The apps share an installation under a single Google Play listing.
3. Licence
Subject to your compliance with these Terms and payment of the applicable subscription fee, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use BluePadel on Android devices that you own or control, solely for your own non-commercial use.
You may not: (a) copy, modify, distribute, resell, or sublicence the apps; (b) reverse-engineer or attempt to extract the source code beyond what applicable law expressly permits; (c) remove or alter any copyright or trademark notices; or (d) use the apps to violate any law or third-party right.
4. Subscription and billing
BluePadel is offered as an annual subscription sold through Google Play. The headline price displayed in our marketing material is in South African Rand (ZAR); Google Play will display and charge you in your local currency.
Your subscription auto-renews each year until you cancel it. Google Play will charge the payment method on your Google account on each renewal date. We do not handle or store your payment details — billing is governed by Google's terms and the Google Play Terms of Service.
5. Free trial
If a free trial is offered when you subscribe, the trial period and conversion behaviour are as described in Google Play at the time you start the trial. Cancelling before the trial ends prevents any charge.
6. Cancellation
You may cancel your subscription at any time through Google Play (Subscriptions → BluePadel → Cancel). Cancellation takes effect at the end of the current billing period; you keep access until then. Uninstalling the app does not by itself cancel the subscription — you must cancel through Google Play.
7. Refunds
Refunds for subscription payments are processed under Google Play's refund policy. Where the Consumer Protection Act, 2008 (South Africa) or other applicable law gives you a stronger refund right than Google Play's standard policy, that statutory right prevails. To request a refund, follow the steps at support.google.com/googleplay. If Google declines a request you believe is owed to you by statute, contact us at hello@bluepadel.co.za.
8. Acceptable use
BluePadel is for personal padel scoring. You agree not to use the apps in connection with anything illegal, harmful, or that could damage the apps' reputation or operation. The apps don't host user content, so there is no community-content policy — but please don't try to reverse-engineer or tamper with our intellectual property.
9. Intellectual property
BluePadel, the BluePadel name and logo, the wordmark, and the underlying software are owned by Ward & Partners and protected by South African and international copyright and trademark law. These Terms grant you a licence to use the apps, not any ownership of them.
10. Third-party services
BluePadel runs on Android and Wear OS, is distributed through Google Play, and uses Google's Wearable Data Layer API to sync between paired devices. Your use of those underlying services is governed by Google's own terms and privacy policy. We are not responsible for them.
11. Disclaimers
The apps are provided "as is" and "as available" to the maximum extent permitted by law. We do not warrant that scoring will be uninterrupted, that the apps will be compatible with every Wear OS or Android device or version, or that any feature will continue indefinitely. The Consumer Protection Act, 2008 still applies where it gives you stronger rights as a consumer.
12. Limitation of liability
To the maximum extent permitted by law, our total liability arising from or in connection with the apps and these Terms is limited to the amount you paid us (via Google Play) for the subscription period in which the claim arose. We are not liable for indirect, incidental, consequential, or punitive damages, or for loss of profits, goodwill, or data, except to the extent applicable law prohibits limiting such liability.
Nothing in these Terms excludes or limits any liability that, by law, cannot be excluded or limited, including liability for death or personal injury caused by negligence or for fraud.
13. Indemnity
You agree to indemnify and hold us harmless from any claim arising out of your breach of these Terms or your misuse of the apps, including reasonable legal costs.
14. Termination
We may suspend or terminate your access to the apps if you materially breach these Terms. On termination, the licence granted in clause 3 ends and you must stop using the apps. Cancellation of your subscription is sufficient on your side; you do not need to notify us.
15. Changes to these Terms
We may update these Terms from time to time. If a change materially reduces your rights, we'll give you reasonable advance notice (in-app or by updating the "Last updated" date at the top of this page). Continued use of the apps after the change takes effect constitutes acceptance.
16. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have non-exclusive jurisdiction. Nothing in this clause prevents you from bringing a claim in the consumer-protection forum nearest to where you live, as permitted by law.
